Welcome to SOVY.
These Terms of Service ("Terms") govern your access to and use of the SOVY website, online store, products, content, features and related services (collectively, the "Services").
The terms "SOVY", "we", "us" and "our" refer to the business operating SOVY.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
By accessing the Services or placing an order, you agree to these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy.
Nothing in these Terms limits or excludes any mandatory rights that you may have under applicable consumer protection law.
If any provision of these Terms conflicts with a mandatory consumer protection law applicable to you, that mandatory law will prevail.

Our contractual relationship for purchases made through this store is between you and SOVY, not Shopify or any third-party supplier, manufacturer, fulfillment partner or shipping carrier.
SECTION 2 — ELIGIBILITY AND ACCOUNTS
By using the Services or placing an order, you represent that you have the legal capacity required to enter into a binding agreement under the laws applicable to you.
If customer accounts are available, you are responsible for maintaining the confidentiality and security of your account credentials and for providing accurate, current and complete information.
You must promptly notify us if you become aware of unauthorized use of your account.
You may not use the Services for fraudulent, unlawful or unauthorized purposes.
SECTION 3 — PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, measurements, specifications, pricing and other information displayed on our website are accurate.
However, colors and appearance may vary slightly depending on your device, screen settings, manufacturing batches or other reasonable production variations.
Minor differences that do not affect the functionality or essential characteristics of a product may occur.
Nothing in this section excludes your legal rights where a product is defective, damaged, materially different from its description or otherwise does not conform to the contract.
Product availability may change without notice.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
SECTION 4 — THIRD-PARTY FULFILLMENT AND DROPSHIPPING
Some products sold by SOVY may be manufactured, stored, processed, fulfilled or shipped on our behalf by third-party suppliers, warehouses, logistics providers or fulfillment partners.
These partners may operate from locations different from our business address and, depending on the product and destination, may operate outside your country of residence.
The use of third-party fulfillment does not change the identity of your seller. Unless expressly stated otherwise, your purchase contract is with SOVY and you should contact SOVY regarding your order, delivery, return, refund or product issue.
We may provide information necessary to fulfill your order to our suppliers, fulfillment partners and carriers in accordance with our Privacy Policy.
SECTION 5 — ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the products in your order.
After you place an order, you may receive an automated confirmation acknowledging that we have received it. An acknowledgment of receipt does not necessarily constitute final acceptance of the order.
The contract is formed when we accept the order, normally when we confirm that the order has been accepted or begins fulfillment, depending on the circumstances and applicable law.
We reserve the right to reject or cancel an order before acceptance for legitimate reasons, including suspected fraud, payment failure, product unavailability, duplicate orders, shipping restrictions or an obvious pricing or listing error.
If we cancel an order after payment has been collected, we will refund the amount due to you using the original payment method, subject to applicable law.
Please review your shipping address, products, quantities and other information carefully before submitting an order.
Once an order has entered fulfillment, we may not always be able to modify or stop the shipment.
This does not affect any cancellation, withdrawal, return, refund or other rights that cannot legally be excluded.
SECTION 6 — PRICES, TAXES AND PAYMENT
Prices displayed on the website are shown in the currency indicated on the store.
We reserve the right to change prices at any time. Price changes will not affect orders already accepted except where permitted by applicable law, such as in the case of an obvious error.
For consumers in the European Union and other jurisdictions requiring it, applicable taxes and mandatory charges will be included in, or clearly disclosed as part of, the total price before the order is placed.
Shipping costs, where applicable, will be displayed before checkout or otherwise clearly disclosed before you are bound by the purchase.
Depending on the destination and fulfillment arrangement, international shipments may be subject to customs procedures, import duties or other charges.
Where applicable law requires such charges to be included in the advertised or final price, we will comply with that requirement. Where additional import charges may lawfully be payable by the recipient, this will be communicated as required before purchase.
You agree to provide valid and accurate payment and billing information and represent that you are authorized to use the payment method provided.
Payment processing may be performed by Shopify Payments or other third-party payment processors.
SECTION 7 — SHIPPING AND DELIVERY
Shipping methods, estimated processing times and estimated delivery timeframes are described in our Shipping Policy and/or during checkout.
Delivery estimates are estimates unless we expressly agree to a guaranteed delivery date.
Orders may be shipped in more than one package and, where third-party fulfillment providers are used, different items in the same order may be shipped from different locations.
We may experience delays caused by circumstances outside our reasonable control, including carrier disruption, customs procedures, severe weather, strikes, natural disasters, public authority actions, transportation disruption or other force majeure events.
However, nothing in these Terms removes any mandatory statutory rights you may have if an order is not delivered within the agreed period.
For consumers subject to European Union consumer law, unless a different delivery period has been expressly agreed, goods will be delivered without undue delay and generally no later than 30 days after conclusion of the contract, as required by applicable law.
If we fail to deliver within an applicable agreed or legally required period, you may have the right to require delivery within an additional reasonable period and, where applicable, terminate the contract and receive a refund.
SECTION 8 — RISK OF LOSS AND DELIVERY
Where mandatory consumer protection law applies, risk of loss or damage remains with SOVY until you, or a third party designated by you other than the carrier, takes physical possession of the goods.
If you independently arrange a carrier that was not offered by us, risk may transfer when the goods are delivered to that carrier where permitted by applicable law.
A carrier tracking status marked "delivered" may be considered evidence of delivery but will not automatically eliminate rights you may have under applicable law if you genuinely did not receive the shipment.
If tracking indicates delivery but you cannot locate your package, please contact us at sovysleep@outlook.com as soon as reasonably possible so that we can investigate the shipment with the carrier or fulfillment provider.
SECTION 9 — ADDRESS ERRORS, FAILED DELIVERY AND UNCLAIMED PACKAGES
You are responsible for providing a complete and accurate shipping address.
If you discover an error, contact us as soon as possible at sovysleep@outlook.com.
We cannot guarantee that an address can be changed after fulfillment has started.
Where a delivery fails because the customer supplied an incorrect or incomplete address, refused delivery without exercising a legal right, or failed to collect a shipment after reasonable carrier attempts, we may charge reasonable additional shipping costs actually incurred in resending the order where permitted by law.
We will not impose charges where the failed delivery resulted from our error or where doing so would violate mandatory consumer law.
SECTION 10 — RETURNS, WITHDRAWAL AND REFUNDS
Returns and refunds are governed by our Refund Policy, which forms part of these Terms.
Our commercial return policy does not limit any mandatory statutory rights.
Consumers in the European Union generally have the right to withdraw from eligible distance purchase contracts within 14 days without giving a reason, subject to statutory exceptions.
Where SOVY voluntarily provides a longer return period, such as a 30-day return policy, that additional commercial return period exists alongside and does not replace mandatory consumer rights.
Instructions, eligibility requirements and procedures for returns are described in our Refund Policy.
SECTION 11 — LEGAL GUARANTEE AND NON-CONFORMING PRODUCTS
Nothing in these Terms excludes or limits legal guarantees or statutory rights relating to defective or non-conforming goods.
If you are a consumer in the European Union, you are entitled to the applicable legal guarantee of conformity provided by law.
For consumers in Spain, SOVY is responsible for a lack of conformity existing at the time of delivery that becomes apparent within the statutory period applicable under Spanish consumer law, which is currently three years from delivery for new goods.
Depending on applicable law and the circumstances, available remedies may include repair, replacement, price reduction or termination of the contract and refund.
Any commercial warranty that we may voluntarily offer is additional to, and does not replace or reduce, mandatory legal guarantee rights.

SECTION 12 — DAMAGED, INCORRECT OR MISSING ITEMS
Please inspect your order after delivery.
If an item arrives damaged, defective, incomplete or materially different from what you ordered, contact sovysleep@outlook.com and provide your order number and reasonable evidence of the issue where necessary to investigate the claim.
We may request photographs or other reasonable information to verify damage, incorrect products or missing components.
Such requests are intended to help us investigate claims and do not remove statutory consumer rights.
SECTION 13 — PROMOTIONS AND DISCOUNTS
We may offer discounts, promotional codes, bundles or other promotional offers from time to time.
Promotions may be subject to specific conditions displayed with the offer.
Unless otherwise stated, promotions cannot be combined.
Promotional terms will not affect mandatory consumer rights.
We may refuse or cancel the fraudulent, abusive or unauthorized use of promotional offers.
SECTION 14 — INTELLECTUAL PROPERTY
The Services and their content, including our branding, logos, text, graphics, photographs, videos, website design and other materials, are owned by or licensed to SOVY or the relevant rights holders and are protected by applicable intellectual property laws.
You may use the website for personal and lawful purposes.
You may not reproduce, distribute, modify, sell, commercially exploit or otherwise use protected content without permission from the relevant rights holder, except where permitted by law.
Shopify and its associated trademarks belong to Shopify or its licensors.
SECTION 15 — REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit a review, photograph, testimonial, comment or other content for publication through our Services, you confirm that you have the right to submit that content and that it does not unlawfully infringe the rights of another person.
You grant SOVY a non-exclusive, worldwide, royalty-free license to display, reproduce and use that content for operating, improving and promoting the Services, subject to applicable privacy and intellectual property laws.
We may moderate or remove content that is fraudulent, unlawful, abusive, misleading, infringing, irrelevant or otherwise violates these Terms.
We will not knowingly manipulate customer reviews in a manner prohibited by applicable consumer protection law.
SECTION 16 — THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with services operated by third parties.
We are not responsible for the content, availability, privacy practices or independent activities of third-party websites that we do not control.
Your use of third-party services may be governed by separate terms and privacy policies.
This section does not exclude liability that applicable law does not permit us to exclude.
SECTION 17 — RELATIONSHIP WITH SHOPIFY
SOVY is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make through our store are made directly with SOVY.
Shopify is not the seller of the products offered by SOVY and is not responsible for fulfillment of orders, product quality, returns, refunds or other obligations of SOVY as seller, except to the extent Shopify independently provides a service directly to you under its own terms.
Certain personal information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy documentation.
SECTION 18 — PRIVACY
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, why we process it, who it may be shared with, how long it may be retained and the rights that may be available to you.

SECTION 19 — PROHIBITED USES
You must not use the Services to engage in unlawful, fraudulent, abusive or malicious conduct.
You must not intentionally interfere with the operation or security of the Services, distribute malware, attempt unauthorized access, fraudulently obtain products or refunds, infringe intellectual property rights, impersonate another person, scrape or exploit the Services in violation of applicable law, or use the Services in a manner intended to harm SOVY, its customers or third parties.
We may restrict or terminate access to the Services where reasonably necessary in response to a material violation of these Terms, fraud, abuse or security risk.
Termination will not affect rights or obligations arising from orders already concluded or mandatory consumer rights.
SECTION 20 — ERRORS AND OBVIOUS MISTAKES
Occasionally, information on the Services may contain typographical, technical or other errors relating to descriptions, prices, promotions, shipping costs, delivery estimates or availability.
We may correct such errors when discovered.
Where an error affects an order already submitted, we will handle the matter in accordance with applicable contract and consumer protection law.
Nothing in this section gives us an unrestricted right to unilaterally alter an already concluded consumer contract.
SECTION 21 — SERVICE AVAILABILITY
We aim to keep the website and Services available, but we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend or restrict parts of the Services for maintenance, security, technical or operational reasons.
This section relates to availability of the website and does not remove our obligations relating to orders already accepted.
SECTION 22 — DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, we do not guarantee that the website itself will always be uninterrupted, error-free or completely secure.
However, nothing in these Terms excludes or limits:
mandatory consumer guarantees;
legal rights regarding conformity of goods;
liability that cannot legally be excluded or limited;
or any other mandatory rights provided by applicable law.
Products are therefore not sold "as is" where such wording would remove or reduce mandatory statutory consumer rights.
SECTION 23 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms is intended to exclude liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence where it cannot legally be excluded, death or personal injury where liability cannot legally be excluded, defective products where mandatory product liability rules apply, or mandatory consumer protection obligations.
To the extent permitted by law, SOVY will not be liable for losses that were not reasonably foreseeable when the contract was entered into or that result from circumstances for which SOVY is not legally responsible.
For consumers, this section does not reduce any mandatory remedies available under consumer law.
SECTION 24 — EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be considered in breach of these Terms for a delay or failure caused by an event outside our reasonable control to the extent recognized by applicable law.
Such events may include severe weather, natural disasters, war, terrorism, civil disorder, epidemics, government measures, customs disruption, widespread carrier disruption, strikes, infrastructure failures or comparable events.
We will take reasonable steps to minimize the effect of such events.
Mandatory rights relating to cancellation, termination or refunds are not excluded by this section.
SECTION 25 — SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent legally permitted and, where necessary, will be severed.
The remaining provisions will continue in effect.
SECTION 26 — NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
A waiver will only apply to the specific circumstances in which it is given.
SECTION 27 — ASSIGNMENT
You may not transfer rights or obligations under these Terms where doing so would materially affect performance of the contract without our agreement, except where applicable law provides otherwise.
We may transfer our rights or obligations as part of a legitimate business restructuring, merger, acquisition, sale or similar transaction, provided that doing so does not reduce your mandatory consumer rights.
SECTION 28 — GOVERNING LAW AND JURISDICTION
These Terms and contracts entered into with SOVY are governed by the laws of Spain, subject to mandatory consumer protection rules that may apply in the country where you habitually reside.
If you are a consumer residing in the European Union or another jurisdiction providing mandatory consumer protections, the choice of Spanish law does not deprive you of protections that cannot lawfully be excluded under the law applicable to you.
Nothing in these Terms requires a consumer to bring proceedings exclusively in Spain where applicable law gives that consumer the right to bring proceedings before another competent court, including courts in the consumer's place of residence where applicable.
For disputes that are not consumer disputes and where legally permitted, the competent courts will be those determined under applicable Spanish law.
SECTION 29 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any additional conditions expressly presented at checkout, constitute the agreement governing your use of the Services and purchases from SOVY.
Specific terms expressly agreed for an order will prevail over inconsistent general provisions in these Terms to the extent required by law.
SECTION 30 — CHANGES TO THESE TERMS
We may update these Terms from time to time for legal, regulatory, operational, security or business reasons.
The current version will be published on this website with the date of the latest update.
Material changes will be communicated where required by applicable law.
Changes to these Terms will not retroactively alter the contractual terms of an order already concluded unless permitted by law or agreed with you.
